1. Purpose and Scope
This Acceptable Use Policy (“AUP” or “Policy”) establishes the rules governing acceptable behavior and permitted use of the RaffleTracker mobile application, website (raffletracker.app), and all associated services (collectively, the “Platform”).
RaffleTracker operates solely as a discovery and promotional listing platform that provides users with information about giveaways conducted by independent third-party Partners. RaffleTracker does not sponsor, administer, operate, manage, conduct, or control any sweepstakes, raffles, contests, lotteries, or promotional drawings listed on the Platform. All promotions listed on the Platform are conducted exclusively by the respective Partners, and all entry submissions, eligibility determinations, winner selection, prize fulfillment, and compliance with applicable laws are the sole responsibility of the Partner conducting the promotion. Participation in any Giveaway occurs exclusively on the Partner’s website. RaffleTracker does not accept entry submissions, process payments for promotion entries, determine winners, distribute prizes, or otherwise participate in the operation of any promotion. The Platform merely provides a directory of promotional opportunities and does not constitute a gambling service, lottery operator, raffle administrator, or promotion sponsor.
1.1 Who This Policy Applies To
This Policy applies to all individuals and entities that access or use the Platform, including:
- Users: Individuals who browse, search, save, follow, or interact with Giveaway Listings on the Platform, whether or not they create an account;
- Registered Users: Individuals who create a user account on the Platform;
- Partners: Businesses and individuals approved for Partner accounts who submit Giveaway Listings for display on the Platform;
- Visitors: Individuals who access the Platform website or any associated web properties without creating an account;
- Developers: Individuals or entities that interact with the Platform through APIs, integrations, or other technical interfaces, if and when made available.
1.2 Relationship to Other Agreements
This Acceptable Use Policy is incorporated into and forms a part of the RaffleTracker User Terms of Service for users and the RaffleTracker Partner Terms of Service for Partners. A violation of this Policy constitutes a violation of the applicable Terms of Service. This Policy also supplements the following RaffleTracker agreements and policies:
- Content Moderation Policy;
- Content License Agreement;
- Giveaway Compliance Acknowledgment;
- Privacy Policy.
In the event of a conflict between this Policy and the applicable Terms of Service, the more restrictive provision shall control. Defined terms not defined in this Policy have the meanings given to them in the applicable Terms of Service.
1.3 Consequences of Violation
Violation of this Policy may result in one or more of the following consequences, at RaffleTracker’s sole discretion: warning notice, content removal, account suspension, permanent account termination, prohibition from future Platform use, legal action, or referral to law enforcement or regulatory authorities. Specific enforcement procedures are described in Section 8 of this Policy and in the RaffleTracker Content Moderation Policy.
1.4 Minimum Age Requirement
The Platform is intended for use by individuals who are at least eighteen (18) years old. If you are under eighteen (18), you may not use, access, or register for an account on the Platform. By using the Platform, you represent that you are at least eighteen (18) years of age.
The eighteen (18) year age requirement is in place because the Platform may display promotions involving regulated products such as firearms, ammunition, alcohol, tobacco, and other age-restricted items. While RaffleTracker does not sell or distribute these products, the nature of the content displayed on the Platform is not appropriate for individuals under the age of eighteen (18).
Certain promotions displayed on the Platform may have additional eligibility requirements, including minimum age requirements of twenty-one (21) years or older for promotions involving alcohol, certain firearm transfers, or other products restricted by law. These additional age requirements are determined by the Partner conducting the promotion. Users are responsible for reviewing the eligibility requirements of each promotion before participating.
2. General Use Requirements
All users and Partners must use the Platform in a lawful, responsible, and respectful manner. By accessing or using the Platform, you agree to:
- Comply with all applicable federal, state, local, and international laws and regulations;
- Use the Platform only for its intended purpose of discovering, browsing, and sharing promotional giveaways;
- Provide accurate, current, and complete information when creating an account or submitting content;
- Maintain the security of your account credentials and promptly notify RaffleTracker of any unauthorized access;
- Respect the rights of other users, Partners, and RaffleTracker;
- Comply with this Policy, the applicable Terms of Service, and all other Platform policies.
All users are responsible for their own activity on the Platform. If you allow another person to use your account, you are responsible for their actions.
3. Prohibited Activities — All Users
The following activities are strictly prohibited for all users of the Platform, regardless of account type.
3.1 Fraudulent and Deceptive Conduct
- Creating accounts using false, misleading, or stolen identity information;
- Impersonating any person, business, brand, or entity, or falsely representing your affiliation with any person or entity;
- Submitting false or misleading information to RaffleTracker, including in account registration, user reports, appeals, or communications;
- Using the Platform to facilitate any fraudulent scheme, confidence game, or other deception;
- Filing false reports against other users or Partners.
3.2 Illegal Activity
- Using the Platform for any purpose that violates applicable federal, state, local, or international law;
- Promoting, facilitating, or participating in illegal gambling, unlicensed lotteries, or unlawful raffles through the Platform;
- Using the Platform to distribute, advertise, or facilitate the sale of illegal goods or controlled substances;
- Engaging in money laundering, terrorist financing, or other financial crimes through or in connection with the Platform;
- Using the Platform in connection with any activity subject to economic sanctions or export controls.
3.3 Harassment and Harmful Conduct
- Harassing, threatening, intimidating, stalking, or bullying other users, Partners, or RaffleTracker personnel;
- Posting or transmitting content that is defamatory, obscene, hateful, or incites violence;
- Discriminating against any individual or group on the basis of race, ethnicity, gender, religion, national origin, disability, sexual orientation, age, or any other legally protected characteristic;
- Doxxing (publishing private personal information of another individual without their consent);
- Encouraging or inciting others to engage in harmful or illegal conduct.
3.4 Bot Activity, Automation, and Scraping
The use of automated systems to interact with the Platform is prohibited unless expressly authorized in writing by RaffleTracker. Prohibited automated activities include:
- Using bots, scripts, crawlers, spiders, or other automated tools to access, browse, search, or interact with the Platform;
- Automated creation, registration, or management of user or Partner accounts;
- Scraping, harvesting, extracting, or systematically collecting data from the Platform, including Giveaway Listing data, partner information, user data, or engagement metrics;
- Automated clicking, tapping, or interacting with Giveaway Listings, Entry URLs, partner links, or Platform features;
- Automated submission of Partner Giveaway Listings through the Partner Portal;
- Using any automated system to generate artificial traffic, impressions, clicks, or engagement on the Platform.
Exceptions to this prohibition require prior written authorization from RaffleTracker and must be documented in a separate written agreement.
3.5 Artificial Engagement Manipulation
Users and Partners may not artificially inflate, manipulate, or misrepresent engagement metrics on the Platform. Prohibited conduct includes:
- Using traffic farms, click farms, bot networks, or paid engagement services to inflate favorites, follows, watcher counts, or other engagement metrics;
- Creating multiple accounts to artificially boost engagement on specific listings;
- Coordinating with other users to manipulate engagement metrics through scripted or inauthentic activity;
- Purchasing or selling fake engagement (such as fake favorites or follows) on any third-party marketplace;
- Using any tool, service, or method designed to simulate authentic user engagement with the Platform.
RaffleTracker does not guarantee the accuracy of engagement metrics displayed on the Platform. Partners may not rely on Platform-displayed metrics for regulatory disclosures, legal representations, odds calculations, or any official reporting purposes.
3.6 Referral and Attribution Abuse
RaffleTracker may use tracking parameters, referral codes, or similar attribution mechanisms in Entry URLs to measure Platform performance and partner referral activity. Users and Partners may not:
- Remove, alter, strip, or modify RaffleTracker attribution parameters or referral codes from Entry URLs;
- Circumvent, bypass, disable, or interfere with Platform attribution mechanisms through URL manipulation, redirect chains, link masking, or any other technical means;
- Artificially inflate referral metrics through scripted traffic, bot activity, or coordinated inauthentic behavior;
- Provide false or misleading referral data to RaffleTracker or Partners.
RaffleTracker reserves the right to investigate suspicious referral activity and to suspend or terminate accounts involved in attribution abuse.
3.7 Security Violations
Users may not attempt to compromise the security, availability, or integrity of the Platform or any systems connected to it. Prohibited security-related conduct includes:
- Attempting to gain unauthorized access to any portion of the Platform, other user accounts, Partner accounts, or any RaffleTracker systems, servers, or networks;
- Exploiting, testing, or probing security vulnerabilities in the Platform without prior written authorization from RaffleTracker (authorized security research requires a separate written agreement);
- Bypassing, disabling, or circumventing authentication controls, access restrictions, rate limits, or other security measures;
- Uploading, transmitting, or distributing viruses, worms, trojans, ransomware, spyware, adware, or any other malicious code or software;
- Launching denial-of-service (DoS) attacks, distributed denial-of-service (DDoS) attacks, or any other attack designed to disrupt or degrade Platform performance;
- Intercepting, monitoring, or sniffing network traffic to or from the Platform without authorization;
- Interfering with or disrupting Platform infrastructure, servers, content delivery networks, databases, or any systems or networks connected to the Platform.
Any attempted breach of Platform security may result in immediate and permanent termination of access and referral to law enforcement authorities. RaffleTracker reserves all legal rights and remedies in connection with security violations.
3.8 Circumvention of Platform Safeguards
Users may not attempt to bypass, disable, interfere with, or circumvent:
- Content moderation systems, including pre-publication review and automated content filtering;
- Fraud detection and prevention mechanisms;
- Partner verification and approval processes;
- Engagement tracking and attribution systems;
- Account restrictions, suspensions, or bans (including creating new accounts to evade enforcement);
- Age restrictions, geographic restrictions, or eligibility controls;
- Rate limits, access controls, or other technical restrictions.
Attempting to circumvent Platform safeguards is treated as a serious violation and may result in immediate permanent ban without prior notice.
3.9 Intellectual Property Violations
- Uploading, posting, or transmitting content that infringes the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party;
- Using RaffleTracker’s name, logo, trademarks, or branding in any unauthorized manner;
- Removing, altering, or obscuring any copyright, trademark, or other proprietary notices displayed on or through the Platform;
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or data structures of the Platform.
Intellectual property complaints, including DMCA notices, should be directed to legal@raffletracker.app. RaffleTracker’s DMCA procedures are described in the Content Moderation Policy.
3.10 Spam and Unsolicited Communications
- Sending unsolicited messages, promotions, or advertisements to other users through Platform features;
- Posting repetitive, duplicative, or irrelevant content designed to disrupt the Platform experience;
- Using the Platform to harvest email addresses, contact information, or other personal data for unsolicited communications;
- Engaging in any form of chain messaging, bulk messaging, or commercial solicitation not authorized by RaffleTracker.
4. Additional Partner Obligations
In addition to the general prohibitions in Section 3, Partners are subject to the following additional requirements. These obligations supplement (and do not replace) the Partner Terms of Service, Content License Agreement, and Giveaway Compliance Acknowledgment.
4.1 Promotion Legitimacy
Partners must ensure that every Giveaway Listing submitted to the Platform represents a genuine promotional offering with a real, fulfillable prize. Partners may not:
- Submit fake, sham, or fraudulent Giveaways with no genuine intent to award the stated prize;
- Misrepresent the nature, value, quantity, or availability of any prize;
- Advertise prizes that the Partner does not own, possess, or have the ability to obtain and deliver;
- Submit listings for promotions that have already ended or for which prizes have already been awarded;
- Use the Platform to collect personal data under false pretenses through fraudulent or non-existent Giveaways.
4.2 Legal Compliance
Partners are solely and exclusively responsible for the legality of their promotions. Partners must:
- Comply with all applicable federal, state, local, and international sweepstakes, contest, and promotional marketing laws;
- Not submit promotions that constitute unlicensed lotteries, unlawful raffles, illegal gambling, or deceptive trade practices;
- Include all legally required disclosures, official rules, no-purchase-necessary statements, and eligibility requirements;
- Obtain all required state registrations, bonds, or filings for jurisdictions where the Giveaway is offered;
- Comply with all applicable advertising, consumer protection, data privacy, and tax reporting laws.
RaffleTracker does not verify, certify, or approve the legality of any Partner Giveaway. Publication on the Platform does not constitute legal review or approval.
4.3 Entry URL Standards
Partners must ensure that all Entry URLs submitted with Giveaway Listings meet the following standards:
- Direct users to a secure (HTTPS) webpage operated and controlled by the Partner or the Partner’s authorized promotion administrator;
- Load correctly and remain functional for the duration of the Giveaway;
- Do not redirect through misleading, deceptive, or malicious intermediate pages;
- Do not contain malware, phishing attempts, credential harvesting, or other security threats;
- Do not collect personal information beyond what is disclosed in the Giveaway’s official rules and privacy policy;
- Do not automatically download files or software to the user’s device.
4.4 Platform Non-Replication
Partners may not use non-public Platform information, including Restricted Platform Information as defined in the Partner Terms of Service, to develop, operate, assist, or invest in any competing service. This includes reverse engineering, decompiling, or systematically analyzing the Platform for the purpose of replicating its features, workflows, or user experience. Full details are set forth in Section 9 of the Partner Terms of Service.
4.5 Non-Circumvention of Partnership Structure
Partners shall not intentionally solicit, contact, or redirect RaffleTracker users for off-platform promotional participation in a manner designed to circumvent the Platform’s tracking, attribution, discovery, or partnership structure. Partners shall not embed hidden redirects, tracking pixels, or data collection mechanisms in Giveaway Listings designed to capture RaffleTracker user data for off-platform solicitation. This restriction does not prevent Partners from promoting their Giveaways through their own independent marketing channels to audiences they acquired independently of the Platform.
5. Abuse of Platform Features
The Platform provides features designed to enhance giveaway discovery and user engagement. These features must be used as intended and may not be misused or exploited.
5.1 Account Features
- Users may create only one personal account. Creating multiple accounts for deceptive, manipulative, or abusive purposes is prohibited;
- Account credentials must not be shared with third parties. Each account is for the exclusive use of the registered individual;
- Account information (username, email, display name) must not be misleading, offensive, or designed to impersonate another person or entity.
5.2 Discovery and Engagement Features
- Favorites, follows, and watchlist features must reflect genuine user interest and may not be used to artificially inflate metrics;
- Search features must be used for their intended discovery purpose and may not be exploited to probe Platform data or test automated extraction methods;
- Sharing features must be used to share content with individuals who would reasonably be interested in the content.
5.3 Reporting Features
- In-app reporting and email reporting mechanisms must be used in good faith to report genuine concerns about content or conduct that may violate Platform policies;
- Filing false, frivolous, or retaliatory reports is prohibited and may result in enforcement action against the reporting user;
- Reports must not be used as a competitive tool to harm legitimate Partners or their listings.
6. Platform Integrity and Reputation
RaffleTracker is committed to maintaining a trustworthy, safe, and high-quality discovery platform for users. The following provisions protect Platform integrity:
6.1 Platform Safety
RaffleTracker may suspend, remove, restrict, or decline to publish any content or account that, in its reasonable judgment, may harm the safety of Platform users. This includes content or conduct that poses a risk of physical harm, financial harm, emotional harm, or identity theft to users.
6.2 Platform Reputation
RaffleTracker may take action against any content or account that, in its reasonable judgment, may harm the reputation, integrity, trustworthiness, or public perception of the Platform. This authority exists independently of any specific Policy violation and may be exercised in response to user complaints, negative media coverage, regulatory inquiries, concerns about prize legitimacy, or any other circumstance that may adversely affect user trust.
6.3 Platform Availability
Users and Partners must not take any action that imposes an unreasonable or disproportionate load on Platform infrastructure, disrupts the availability of the Platform for other users, or degrades Platform performance. RaffleTracker reserves the right to throttle, restrict, or block access from any source that threatens Platform availability.
7. Promoted and Sponsored Content
Some Giveaway Listings on the Platform are paid placements by Partners. Promoted listings are subject to the same content standards and acceptable use rules as all other content on the Platform. Additionally:
- Promoted listings will be labeled as “Sponsored,” “Promoted,” “Featured,” or with similar designations in compliance with FTC advertising guidelines;
- Partners may not request, require, or attempt to cause RaffleTracker to conceal the paid nature of any promotional placement;
- Promotional placement does not constitute endorsement, verification, or approval of any Partner, Giveaway, or prize by RaffleTracker;
- Paying for promoted placement does not exempt a listing from compliance with this Policy, the Content Moderation Policy, or any other Platform policy;
- Users should be aware that promoted listings reflect paid visibility and should exercise the same judgment they would apply to any Giveaway Listing.
8. Investigation and Enforcement
8.1 Investigation Authority
RaffleTracker may investigate suspected violations of this Policy at any time. Investigations may include:
- Review of Platform activity logs, access records, and system data;
- Review of submitted Giveaway Listings and Partner Content;
- Analysis of referral traffic patterns, engagement metrics, and attribution data;
- Communication with the user or Partner under investigation;
- Communication with affected users, Partners, or third parties;
- Consultation with legal counsel, law enforcement, or regulatory authorities as appropriate.
Users and Partners agree to cooperate with RaffleTracker investigations. Failure to cooperate, including failure to respond to inquiries or provide requested information, may itself constitute grounds for enforcement action.
RaffleTracker may use automated tools, algorithms, fraud detection systems, and risk-scoring mechanisms to assist with the detection and investigation of Policy violations. Automated systems may be used to flag, restrict, or temporarily suspend content or accounts pending human review. Automated detection supplements but does not replace human review for final enforcement decisions.
8.2 Enforcement Actions
RaffleTracker may take any of the following enforcement actions at its sole discretion:
- Warning: Written notice identifying the violation and the applicable Policy provision.
- Content removal: Removal of specific non-compliant content, listings, or account information.
- Feature restriction: Temporary restriction of specific Platform features (e.g., posting, sharing, reporting).
- Account suspension: Temporary suspension of the user or Partner account pending investigation or cure.
- Account termination: Permanent termination of the user or Partner account and removal of all associated content.
- Permanent ban: Permanent prohibition from creating new accounts or accessing the Platform in any capacity.
- Legal action: Pursuit of available legal remedies, including injunctive relief, damages, and attorneys’ fees.
- Regulatory referral: Notification to relevant regulatory authorities, law enforcement, or other governmental bodies.
8.3 Immediate Action
RaffleTracker may take immediate enforcement action without prior notice in the following circumstances: suspected fraud or scam; malware, phishing, or security threats; content posing immediate risk of harm to users; suspected criminal activity; regulatory inquiry or legal process requiring immediate action; bot activity, scraping, or automated manipulation; security breaches or attempted breaches; or any conduct that RaffleTracker reasonably determines may cause serious harm to Platform safety, integrity, or user trust.
8.4 Repeat Offenders
RaffleTracker maintains records of all enforcement actions. Users and Partners who repeatedly violate this Policy are subject to escalated enforcement, which may include immediate permanent suspension, termination, and permanent ban from the Platform without further notice or cure period. The escalation path described in the Content Moderation Policy (Section 6.3) applies to violations of this Policy.
8.5 Notification
When RaffleTracker takes an enforcement action, RaffleTracker will generally provide notice to the affected user or Partner, including the specific conduct that triggered the action, the applicable Policy provision, and information about the appeals process. RaffleTracker may withhold specific details where disclosure could compromise an investigation, jeopardize user safety, or interfere with a legal proceeding. In cases of immediate action, notice may be provided after the action is taken.
8.6 Ban Evasion
Users and Partners who have been permanently banned from the Platform may not create new accounts, use another person’s account, or access the Platform through any other means. Ban evasion is a separate and independent violation of this Policy and may result in additional enforcement action, including legal action.
9. Reporting Violations
RaffleTracker relies on the community to help identify violations of this Policy. Users and Partners may report suspected violations through the following channels:
9.1 In-App Reporting
The Platform provides in-app reporting functionality that allows users to flag suspicious or problematic Giveaway Listings directly from the listing detail screen. In-app reports are reviewed by RaffleTracker’s moderation team.
9.2 Email Reporting
Users and Partners may submit reports by email:
9.3 Report Requirements
Reports should include:
- The specific listing, account, or conduct being reported;
- A description of the suspected violation and the applicable Policy provision, if known;
- Any supporting evidence (screenshots, URLs, correspondence);
- The reporter’s contact information for follow-up, if applicable.
9.4 Good-Faith Reporting
RaffleTracker reviews all reports in good faith but does not guarantee enforcement action in every case. RaffleTracker will not retaliate against users who submit good-faith reports, and Partners may not retaliate against users who file complaints. Filing false, frivolous, or retaliatory reports is a violation of this Policy.
10. Cooperation with Legal and Regulatory Authorities
RaffleTracker may cooperate with law enforcement agencies, regulatory authorities, and governmental bodies when required by law or when investigating suspected illegal activity conducted through or in connection with the Platform. Cooperation may include:
- Disclosure of relevant account information, activity logs, and Platform data in response to valid legal process (such as subpoenas, court orders, or warrants);
- Voluntary disclosure of information where RaffleTracker reasonably believes disclosure is necessary to prevent imminent harm, protect user safety, or address suspected criminal activity;
- Notification to regulatory authorities when RaffleTracker has reason to believe that a Partner has engaged in unlawful promotion conduct, consumer fraud, or other illegal activity.
All disclosures will be made in accordance with applicable law and the RaffleTracker Privacy Policy. RaffleTracker will comply with valid legal process and will make reasonable efforts to narrow disclosure to information relevant to the specific inquiry.
11. Appeals
Users and Partners who believe an enforcement action was taken in error may submit an appeal to legal@raffletracker.app within thirty (30) days of the enforcement action. Appeals must include the appellant’s name and account information, a description of the enforcement action being appealed, the specific reason the appellant believes the action was in error, and any supporting documentation or evidence.
RaffleTracker will review appeals in good faith and respond within fourteen (14) business days. Appeal decisions are made by RaffleTracker in its sole discretion and are final. Submitting an appeal does not suspend the enforcement action during the review period.
12. Dispute Resolution
Disputes arising out of or relating to this Policy are governed by the dispute resolution provisions of the applicable Terms of Service:
- For Partners: Disputes are subject to the mandatory arbitration, court jurisdiction, injunctive relief, attorney’s fees, and class action waiver provisions set forth in Section 13 of the Partner Terms of Service;
- For Users: Disputes are subject to the governing law, jurisdiction, and class action waiver provisions set forth in the User Terms of Service.
This Policy is governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws principles.
13. Changes to This Policy
RaffleTracker may update this Acceptable Use Policy from time to time to address new risks, changes to the Platform, evolving legal requirements, or other factors. We will notify users and Partners of material changes by posting the updated Policy on the Platform with a revised effective date. Significant changes will be communicated to active Partners via email at least fourteen (14) days before taking effect, except where immediate changes are required for legal compliance, user safety, or fraud prevention.
Continued use of the Platform after changes are posted constitutes acceptance of the revised Policy. We encourage all users and Partners to review this Policy periodically.
